The Women’s Health Center of West Virginia on behalf of its staff and patients has filed a notice to dismiss their lawsuit against the West Virginia Board of Medicine in federal court.
The Center was West Virginia’s lone abortion business. After the U.S. Supreme Court overturned Roe v Wade, West Virginia’s legislature moved to strengthen the ban on abortion. Governor Jim Justice signed the bill last fall and the Center filed suit against the new law. The suit Women’s Health Center of West Virginia v. Sheth, the clinic challenged the regulations in the law requiring any abortion to be performed in a hospital and by a medical professional with West Virginia hospital privileges.
There are still ongoing legal challenges involving the state and an abortion drug manufacturer.
